Privacy Policy

CreativeLogicSystem, registered at 99086 Stollbergstraße 63, Erfurt, Germany, is committed to protecting the privacy and personal data of all visitors, clients, and users of our observability and development services. This Privacy Policy describes how we collect, use, store, and protect your personal information in full compliance with Regulation (EU) 2016/679 — the General Data Protection Regulation (GDPR) — and the California Consumer Privacy Act (CCPA).

1.1 Data Controller

The data controller responsible for your personal information is CreativeLogicSystem, reachable at [email protected] or by post at 99086 Stollbergstraße 63, Erfurt, Germany.

1.2 Data We Collect

We collect personal data you voluntarily provide through our contact forms, project briefs, and consultation consoles. This includes your full name, email address, phone number, company name, and any project specifications you submit. We also collect standard web analytics data such as IP addresses, browser type, device information, and page interaction metrics via server logs and privacy-respecting analytics tools.

1.3 Purpose of Processing

Your personal data is processed exclusively for the following purposes: responding to your project inquiries and consultation requests; preparing technical proposals and scope analyses; executing agreed-upon development and observability contracts; fulfilling statutory tax and financial reporting obligations; and improving our platform's performance and security. We do not process your data for automated decision-making or profiling purposes.

1.4 Legal Basis for Processing

We process personal data under GDPR Article 6(1)(b) — performance of a contract or pre-contractual steps at your request — and GDPR Article 6(1)(f) — legitimate interest in responding to business inquiries and maintaining service quality. Where consent is required, it is obtained explicitly before processing begins.

1.5 Data Retention

Personal data is retained only for as long as necessary to fulfill the purposes for which it was collected. Contact form submissions are retained for 24 months. Contract-related data is retained for the duration of the engagement plus 10 years in compliance with German commercial record-keeping obligations under §257 HGB.

1.6 Data Security

We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. Our infrastructure is hosted within the European Union with AES-256 encryption at rest, TLS 1.3 in transit, and ISO/IEC 27001-aligned access controls.

1.7 Data Sharing

CreativeLogicSystem does not sell, rent, or trade personal information to third parties. Data may be shared with essential service providers who support our operations, including cloud infrastructure providers (within EU data processing agreements), payment processors, and professional advisors bound by confidentiality obligations. All third-party processors are vetted and bound by GDPR-compliant data processing agreements.

1.8 International Transfers

We prioritize hosting all data within the European Economic Area. Where data must be transferred outside the EEA, we ensure appropriate safeguards are in place, including EU Standard Contractual Clauses (SCCs) and adequacy decisions as recognized by the European Commission.

1.9 Your Rights

Under GDPR, you have the right to: access your personal data; rectify inaccurate data; request erasure of your data; restrict processing; data portability; object to processing; and withdraw consent at any time. To exercise these rights, contact us at [email protected]. You also have the right to lodge a complaint with a supervisory authority, notably the Thüringer Datenschutzbeauftragter (Thuringian Data Protection Authority).

1.10 California Consumer Privacy Act (CCPA)

For California residents: we do not sell personal information. You have the right to know what personal information we collect, request deletion, opt out of the sale of personal information (which we do not conduct), and not be discriminated against for exercising your CCPA rights. Contact [email protected] to submit a verifiable consumer request.

Terms of Service

These Terms of Service govern all engagements between CreativeLogicSystem, registered at 99086 Stollbergstraße 63, Erfurt, Germany, and any client engaging our observability, creative development, or infrastructure services. By submitting a project brief, signing a Statement of Work, or making a payment, you agree to be bound by these terms.

2.1 Scope of Services

CreativeLogicSystem provides observability platform integration, custom dashboard fabrication, distributed tracing implementation, alert rule orchestration, infrastructure as code deployments, creative web development environments, API observability, performance profiling, SRE retainers, and disaster recovery orchestration. The exact scope of each engagement is defined in a mutually signed Statement of Work (SOW) that specifies deliverables, timelines, pricing, and acceptance criteria.

2.2 Pricing and Payment

All prices quoted are in US Dollars (USD) unless otherwise specified. A 50% deposit is required to initiate work, with the remaining 50% due upon delivery and acceptance of all agreed deliverables. Invoices are payable within 14 days of issuance. Late payments accrue interest at 1.5% per month. Monthly retainer engagements are invoiced on the 1st of each month and payable within 7 days.

2.3 Intellectual Property

Upon complete settlement of all agreed invoices, CreativeLogicSystem assigns all worldwide intellectual property rights in the client-specific software deliverables, custom code, design assets, and documentation directly to the Client. CreativeLogicSystem retains the right to use general methodologies, non-proprietary frameworks, and aggregated non-client-specific knowledge in future engagements.

2.4 Client Responsibilities

The Client is responsible for providing timely access to necessary systems, credentials (via secure vault), and technical environments required for delivery. Delays caused by the Client in providing required access or approvals will proportionally extend delivery timelines. The Client must ensure that data provided does not violate applicable laws or third-party rights.

2.5 Limitation of Liability

CreativeLogicSystem's total aggregate liability under any engagement shall not exceed the total fees paid by the Client for the specific service giving rise to the claim. CreativeLogicSystem shall not be liable for indirect, incidental, consequential, or punitive damages. This limitation does not apply to liability arising from gross negligence or intentional misconduct.

2.6 Confidentiality

Both parties agree to maintain strict confidentiality regarding proprietary information, trade secrets, technical specifications, and business strategies disclosed during the engagement. This obligation survives termination of the engagement for a period of 3 years.

2.7 Termination

Either party may terminate an engagement with 30 days' written notice. In the event of termination, the Client shall pay for all work completed up to the termination date. Monthly retainers may be cancelled with 30 days' written notice prior to the next billing cycle.

CreativeLogicSystem, registered at 99086 Stollbergstraße 63, Erfurt, Germany, is committed to fair and transparent refund practices. This Refund Policy outlines the conditions under which refunds or reimbursements may be issued for our observability, creative development, and infrastructure services.

4.1 Pre-Engagement Deposits

The initial 50% deposit is refundable in full if work has not yet commenced and cancellation is requested within 48 hours of deposit payment. After this period or once work has begun, the deposit becomes non-refundable as it covers resource allocation, project planning, and initial system provisioning.

4.2 Milestone-Based Refunds

For projects structured with milestone payments, if a project is terminated after a milestone has been completed and accepted, the payment for that milestone is non-refundable. Payments for unstarted future milestones will be refunded within 14 business days of the termination notice.

4.3 Monthly Retainers

Monthly retainer fees are non-refundable once the billing period has commenced. You may cancel your retainer with 30 days' written notice to avoid future charges. Active work completed during the notice period will be billed at the standard retainer rate.

4.4 Service Quality Disputes

If you believe deliverables do not meet the specifications outlined in the signed Statement of Work, you must notify us within 14 days of delivery. We will review the dispute, and if the deliverables are found to materially deviate from agreed specifications, we will either remedy the deviation at no additional cost or issue a proportional refund for the affected scope.

4.5 Force Majeure

Neither party shall be liable for failure to perform obligations due to events beyond reasonable control, including natural disasters, pandemics, government actions, or infrastructure failures. In such cases, both parties will negotiate in good faith to either reschedule delivery or agree on a fair partial refund.

4.6 Refund Process

All refund requests must be submitted in writing to [email protected] with the subject line "Refund Request — [Project Name]". We will acknowledge receipt within 2 business days and process approved refunds within 14 business days via the original payment method.

4.7 Governing Law

This Refund Policy is governed by the laws of the Federal Republic of Germany. Any disputes arising from refund requests that cannot be resolved amicably shall be submitted to the competent courts of Erfurt, Germany.
